Terms of Use

These Terms of Use ("Terms") govern your use of Jambo: Thinking of You ("Jambo," "the app," or "the Service") provided by Rodgers Tanui ("we," "us," or "our"). By downloading, installing, or using Jambo, you agree to these Terms.

1. The Service

Jambo is an app for iPhone and iPad that lets you send a simple hello, a “Jambo,” to friends you invite. For each friendship it keeps a streak, stars, milestones and insights, and it can remind you when a friend is waiting to hear from you.

2. Eligibility

You must be at least 13 years old to use Jambo. If you're under the age of majority where you live, a parent or guardian must agree to these Terms on your behalf.

3. Friends and invites

You connect with a friend by sharing an invite link. Each link connects you with one person, so share it only with the friend you mean to invite. Your Jambo name is visible to your friends; don't use a name that impersonates someone or is offensive. You can remove a friend at any time.

4. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Jambo for personal, non-commercial purposes on Apple devices you own or control, as permitted by the Apple Media Services Terms and Conditions. You may not copy, modify, reverse engineer or redistribute the app except where the law allows it.

5. Streak Restore

Jambo is free to download and use. Streak Restore is an optional consumable in-app purchase (currently $0.99 USD in the United States, or Apple's equivalent price elsewhere) that brings a broken streak back to its previous count for both friends. Each restore is a separate purchase that is used up when it's applied; it can't be transferred to another friendship or restored later. Streaks, stars and milestones have no monetary value. Purchases are processed by Apple, and refunds are handled by Apple under its policies.

6. Apple-specific terms

These Terms are between you and Rodgers Tanui, not Apple. Apple is not responsible for Jambo or its content, has no obligation to provide maintenance or support for it, and is not responsible for any product claims, including product liability, legal or regulatory compliance, or intellectual property claims. If Jambo fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any; Apple has no other warranty obligation. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

7. Your content

You own the name you choose and the Jambos you send. They are stored in iCloud and shared only with the friend in each friendship. We have no access to them.

8. iCloud and availability

Jambo depends on Apple's iCloud service and your network connection, which we don't control. Notifications may arrive a few minutes late. If a streak breaks because of a service problem, contact us and we'll do our best to help.

9. Acceptable use

Be kind. Don't use Jambo to harass, spam or contact people who don't want to hear from you, don't interfere with the app's operation or security, and don't misrepresent your affiliation with us.

10. Disclaimers

JAMBO IS PROVIDED "AS IS" AND "AS AVAILABLE." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do not guarantee that the app will be error-free or uninterrupted, or that notifications will always be delivered.

11. Limitation of liability

To the maximum extent permitted by law, Rodgers Tanui is not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of Jambo. Our total liability is limited to the amount you paid for Jambo purchases in the twelve months before the claim, or USD $10, whichever is greater.

12. Changes

We may update Jambo and these Terms from time to time. The current Terms are always at jambo.rodgerslabs.com/terms, and continuing to use Jambo after a change means you accept it.

13. Governing law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence apply.
